Flowers Product Terms & Conditions

Please read these product terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco makes the products available to you ("Product Terms").

  1. Prices

    The prices payable for the flowers that you order are clearly set out on the web site. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated.

  2. Availability

    If for any reason beyond our reasonable control, we are unable to supply the flowers, we will notify you as soon as possible. In the event of supply difficulties, we reserve the right to substitute goods or packaging of equal or greater value.

  3. Acceptance

    If you buy an item from Tesco Flowers on the phone or online you will be charged for an item at the time you place your order. After this time, you cannot amend your order (but please see our cancellation policy in section 5 below).

    Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually despatch an item to you, at which point a contract will be made between us. At any point up until then we may decline to supply an item to you. If we decline to supply an item to you and you have already paid for it, we will give you a full refund of any amount already paid for that item in accordance with our refund policy in section 7 below.

  4. Delivery

    A delivery date (the "Delivery Date") will be agreed with you at the time of placing your order. We will confirm the Delivery Date when we send you an email confirming your order.

    Delivery will be made to the address specified by you on the completed order form. Additional delivery charges are included and we can deliver anywhere within the United Kingdom, except the Isle of Man and the Channel Islands. Premium delivery charge for flowers on Mothering Sunday the 2nd of March is £5.00.

    Next day delivery is available for all bouquets ordered before 3.00pm.

    Due to the closure of the online flowers business the last delivery date for all flowers and plants is May 9th 2008.

    PLEASE NOTE: Deliveries to remote areas cannot be guaranteed for the selected delivery date. Flowers and plants may arrive 24 hours later.

    This applies irrespective of any last order dates we may state for special events

    All goods must be accepted by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted the flowers may be retained by the driver. The driver will leave notification of attempted delivery and it is then the recipient's responsibility to contact the courier to arrange delivery or collection.

    Should you have any problems with your flowers order, please call us on 08456 004411 within 48 hours of delivery, quoting the order number shown on the gift card.

    For bouquets: as we can only dispatch orders between Monday and Friday we cannot guarantee delivery for bouquets on Mondays. Bouquet orders placed for delivery on Mondays may be delivered up to two days in advance.

    For postal flowers: if you nominate a delivery date, your order will be dispatched the day before. However, whilst most orders will arrive within 24 hours of dispatch, we are not able to guarantee the date of delivery. Postal flowers are sent dry-packed and after being placed in water, can take up to 24 hours to bloom.

    We will make every effort to deliver your goods on the delivery date; however, we will not be liable if we fail to do so due to circumstances beyond our control.

  5. Cancellation

    You can cancel your order up to 48 hours prior to the delivery date.

    To find out your 'Delivery date' click on the 'My Account' link at the top of the page.

    In high volume periods e.g. Mother's Day, the cancellation period may need to be extended due to operational constraints. In these cases we will display the latest cancellation time below and at the time of ordering.

    Please telephone our Customer Helpline on 08456 004411 and quote your order number, surname and postcode.

    Mothers' Day flowers ordered before 3pm on 25 February 2008 can be cancelled any time until 11pm on 27 February 2008.

    Mothers' Day Flowers ordered after 3pm on 25 February 2008 can only be cancelled on the same day of placing your order.

  6. Payment

    You can pay by any American Express, Tesco Clubcard Plus, Mastercard or Visa credit card, Switch or Delta debit card. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. Payment for flowers products will be taken when you place your order. Clubcard points cannot be awarded to orders placed via our telephone service when customers do not have a valid e-mail address.   7. Refund policy

    A refund will only be possible if our customer service team is contacted before 31st May 2008. After this date refunds on flowers and plants will no longer be possible.

    If you are entitled to a refund, we will refund you as follows:

    1. If you paid by payment card, we will refund you on the payment card;
    2. In the event of a refund, all Clubcard points received for the purchase of a refunded item will be removed from your Clubcard account.
    3. If any additional delivery charge was applicable in your order this will be refunded at the same time.

    Mothers' Day - Requests for refunds concerning 'Mothers' Day' orders must be received within 7 days after the delivery date. This does not affect your statutory rights.

  9. General

    Gifts can only be ordered to accompany courier delivered bouquets. We regret they cannot be ordered alone or added to flowers by post. You must be aged 18 or over to purchase or receive alcohol. Tesco reserves the right to substitute any flowers or products of the same quality and value if necessary. Unless specified, vases are not included.

    These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

    If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
